In a significant verdict, the Indore District Court has awarded a compensation of ₹59 lakhs to the adult sons of a couple killed in a tragic road accident. The court recognized the importance of the deceased’s income tax returns as crucial evidence in calculating the compensation amount.
The accident occurred on March 31, 2021, when Shyam Mukati and his wife, Prembai, residents of Kodaria Ram Nagar, were en route to Indore on their motorcycle. At the Rau Circle, their vehicle was hit by a truck, leading to their immediate demise due to the severe impact of the collision.
The legal battle for compensation was initiated by the deceased’s parents and sons against the insurance company insuring the truck. The case was presented in court by Advocate Rajesh Khandelwal, who submitted the income tax returns of the deceased to establish their income.
Despite various arguments put forth by the insurance company to evade responsibility, the court dismissed all such contentions. Recognizing the income tax returns as valid proof of income, the court ordered the insurance company to compensate the dependents of the deceased with a sum of ₹59,23,000.
