Supreme Court Stays Allahabad HC Order Appointing Advocate Commissioner to Inspect Shahi Eidgah mosque in Krishna Janmabhoomi Case

On Tuesday the Supreme Court stayed the implementation of the Allahabad High Court order appointing an Advocate Commissioner to inspect the Shahi Eidgah mosque in the Krishna Janmabhoomi case.

Supreme Court was hearing plea objecting to appointment of court commissioner to inspect Shahi-Idgah mosque premises.

Matter was before bench of Justices Sanjiv Khanna and Dipankar Datta.

The Court Ordered:

Issue notice. Tag with transfer matter, list on 23rd January. Proceedings before high court can continue but commission cannot be executed till next date.

On December 14, 2023, in the ongoing Krishna Janmabhoomi-Shahi Idgah dispute in Mathura, the Allahabad High Court, sanctioned a judicially supervised survey of the Shahi Idgah mosque area, which is adjacent to the Krishna Janmabhoomi temple.

The court’s decision to appoint an advocate commissioner for overseeing this survey stems from claims by petitioners that the mosque site contains evidence indicating its past as a Hindu temple.
