In a significant ruling, the Allahabad High Court has taken serious note of a case where a lawyer was falsely accused in an affidavit by a new lawyer without contacting the original lawyer. The court has imposed a penalty of ₹2 lakh each on three individuals and dismissed their petition. Justice Saurabh Shyam Shamshery issued this order on the petition filed by Mohammad Parvez and two others.
The court has instructed the new advocate, Arun Kumar Singh, to send a copy of the order to the petitioners, directing them to deposit the penalty amount with the High Court Legal Services Committee within four weeks. It has also warned of necessary legal actions in case of non-compliance.
Advocate Shyam Sundar Tripathi, who was initially handling the case, stated that the petitioners did not contact him, did not ask for the file back, nor sought his no-objection certificate. He raised an objection to the false claims made in the affidavit submitted by the new lawyer. The court observed that the new lawyer was not present during the proceedings, and the seniority and truthfulness of the previous lawyer seemed credible. The court further remarked that the conduct of the petitioners was not bona fide, as they filed a false affidavit. Therefore, a penalty was imposed.
